Please read these terms carefully before completing your reservation.
"Agreement" means all terms and conditions in the rental record and any additional documents you sign, or we provide at the time of rental. "Renter" means each person signing this Agreement, each Authorized Driver, and every person or organization to whom charges are billed. "We," "our" or "us" means XLane Rentals. "Authorized Driver" means (a) the Renter; (b) any additional driver listed in this Agreement; and (c) any other person defined as an "authorized driver" under applicable law. Each Authorized Driver must have a valid operator's license and be at least age 21. "Vehicle" means the automobile identified in this Agreement and all its tires, tools, accessories, equipment, keys and documents provided inside the vehicle at the time of rental.
Only Authorized Drivers may use the Vehicle. We may repossess the Vehicle at your expense without notice if the Vehicle is abandoned or used in violation of law or this Agreement. If the Renter fails to return the vehicle by the scheduled return time and refuses to return the vehicle despite reasonable attempts by XLane to make contact, the vehicle may be considered unlawfully retained. XLane reserves the right to contact law enforcement and report the vehicle as stolen. You agree to indemnify, defend and hold us harmless from all judgments, claims, liability, costs and attorney fees resulting from this rental and your use of the Vehicle. We make no warranties, express, implied or apparent, regarding the Vehicle. In no event shall we be liable for any indirect, special or consequential damages.
The Vehicle must be returned to the designated return location on the date and time noted in this Agreement and in the same condition received, except for ordinary wear. Our determination of condition is subject to a final inspection which may occur after drop off. If the Vehicle is returned after closing hours, Renter's responsibility for damages continues until final inspection. To extend the rental, Renter must contact us before the due-in date. Renter must return the Vehicle with at least the same amount of fuel as when rented.
Regardless of fault, you are responsible for all damage to, loss of, or theft of the Vehicle during the rental period. Your responsibility may include: (a) physical damage from collisions, weather, vandalism, road conditions, and acts of nature; (b) if the Vehicle is a total loss, the full fair retail market value less salvage; (c) if repairable, the cost of repair plus diminution of value; (d) Loss of Use, measured by multiplying the daily rental rate by the number of days from damage until repaired or replaced; (e) an administrative fee based on the damage.
A security deposit is required for every rental. The deposit may be applied toward damages, violations, loss of use, administrative fees, or any other costs. XLane is not obligated to provide receipts or proof of actual repair costs as a condition of retaining or applying the deposit. XLane's determination of damages and application of the security deposit shall be final and binding.
The following uses constitute material breaches of this Agreement. The Vehicle shall not be used:
The vehicle may only be operated by the individual who completed the reservation and was approved by XLane. No other person is permitted to operate the vehicle unless explicitly approved in writing by XLane prior to use.
Renting a vehicle on behalf of another individual or allowing any unapproved person to operate the vehicle is strictly prohibited and constitutes a fraudulent booking and a material breach of this Agreement. XLane reserves the right to immediately cancel the reservation or terminate the rental without notice. The Renter agrees that:
All renters must complete identity verification at the time of pickup, including submission of a valid driver's license and a real-time selfie with the vehicle. Failure to complete verification may result in cancellation of the reservation without refund.
XLane reserves the right to request additional identity verification at any time during the rental period. Failure to comply may result in immediate vehicle disablement, termination of the rental, and repossession.
Providing false, misleading, or third-party information constitutes a material breach of this Agreement and may result in immediate termination and enforcement actions.
Reservations may be denied or terminated if the renter is determined, at XLane's sole discretion, to be associated with any individual previously banned or restricted from renting, including shared address, contact information, payment method, or known personal/familial relationships.
If the vehicle is operated by anyone other than the Authorized Driver, all protections, coverage options, and limitations of liability are immediately void. The renter assumes full financial responsibility for any and all damages, losses, violations, fees, or claims.
XLane vehicles may be equipped with tracking and remote access technology. By renting, the renter acknowledges that XLane may monitor vehicle location and usage, disable the vehicle in cases of non-compliance, and recover or repossess the vehicle without prior notice.
Any violation of this section may result in immediate termination of the rental agreement, remote disablement of the vehicle, repossession without prior notice, retention of all payments, application of all applicable fees, and reporting the vehicle as stolen if deemed necessary.
No refunds will be issued for any unused rental time if a violation of these terms occurs.
If you purchase Coverage, subject to the terms of this Agreement, we will waive our right to hold you financially responsible for all or a portion of physical damage to the Vehicle as noted on the Rental Record, including charges such as loss of use and administrative fees.
You are responsible for all injury, damage, or loss you cause to yourself and others. We are not responsible for injury or damage you cause to others. You must: (a) report all damage and accidents to us and the police as soon as you discover them and are safe; (b) complete our incident report form; and (c) provide us with a copy of any service of process or notice related to an accident. Any failure to report damage or accidents shall constitute a material breach and may invalidate optional coverage. The Vehicle may not be taken into Mexico under any circumstances.
Cancellations are subject to a 20% cancellation fee based on the total rental amount. Security deposits will be refunded within 10 business days after the vehicle is returned, subject to inspection. All rates, fees, and security deposit amounts are subject to change upon review. Final pricing is determined after verification of renter eligibility, driving history, payment method, and risk assessment. XLane reserves the right to modify or decline any rate prior to vehicle release.
You will pay all Charges including: time charges; mileage charges; optional product and service fees; fuel and refueling fees if you return with less fuel than received; applicable taxes and surcharges; expenses incurred locating and recovering the Vehicle; a reasonable cleaning fee if returned substantially less clean; towing and storage charges; and all other costs resulting from your use of the Vehicle.
A 20% administrative fee will be applied to all tickets and violations incurred during the rental period. A $5 processing fee will be charged for each toll incurred. You are responsible for paying all tolls and parking citations directly. An Outstanding Balance Fee of $35 applies if any outstanding toll balance remains unpaid prior to vehicle return. XLane reserves the right to immediately charge any outstanding balance to the payment method on file.
You agree that we may disclose personally identifiable information to applicable law enforcement agencies or third parties in connection with enforcement of our rights. By signing this Agreement, the Renter and any Authorized Driver expressly authorize XLane to verify the validity of their driver's license and to obtain and review driving history records, motor vehicle reports (MVR), background screening reports, and other eligibility verification information at any time before, during, or after the rental period.
For all vehicle pickups scheduled during physical business hours (7:00 AM to 7:00 PM), the Renter must upload both a valid driver's license and the same debit or credit card used to make the reservation via the QR Code at the facility to verify identity. The vehicle will not be handed over if either item is missing, expired, or does not match the reservation.
For vehicle pickups scheduled outside of business hours, the process will remain contactless. The Renter will receive detailed instructions for remote access to the vehicle prior to the scheduled pickup time. Failure to comply with this policy may result in cancellation of the reservation without a refund.
No term of this Agreement can be waived or modified except by a writing that we have signed. This Agreement constitutes the entire agreement between you and us. This Agreement will be governed by the substantive law of the jurisdiction where the rental commences. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions shall remain valid and enforceable.
